Policy at a glance*
Professional liability coverage helps protect you against a claim resulting from a covered incident. HPSO policies include limits up to $1,000,000 per claim / $3,000,000 annual aggregate.
If a complaint is submitted against you from an applicable licensing agency, you could face the challenge of defending your practice and license. Through Licensure Defense Expenses coverage, you can receive reimbursement up to $25,000 in aggregate for your legal representation arising out of a covered licensure incident.
If you face a professional liability claim, a policy through HPSO pays for legal defense costs for covered claims, irrespective of whether a favorable result is achieved. Defense costs include attorney fees and related expenses and do not reduce your liability coverage limits.
If you experience a HIPAA-related breach, this coverage helps with patient notification expenses (up to $25,000) and pays fines or penalties assessed during a HIPAA proceeding, where permitted by law. (Fines and penalties not available in New York).
Even if you are not named in a lawsuit arising out of your professional services, you may still receive a subpoena (a formal written order requiring you to testify before a court or legal proceedings) to provide documents or testimony. Through Subpoena Assistance Costs, your HPSO policy provides deposition representation, meaning your HPSO policy will pay for the fees charged by an insurer-designated attorney to prepare you for a deposition. The limit for this coverage is a $10,000 annual aggregate.
Proceeding Expense Reimbursement
Your policy through HPSO will reimburse you up to $1,000/day up to a $25,000 annual aggregate for lost wages and other covered travel expenses incurred when you are required to attend a trial, hearing, or proceeding as a defendant in a covered claim.

Assault Coverage
If you become the victim of an assault, either at or while commuting to or from your workplace, this coverage provides reimbursement up to $25,000 annual aggregate, for your covered medical expenses or damage to your personal property (This coverage is not available in Texas).

Non-Patient Medical Expenses
Up to $25,000 per person / $100,000 annual aggregate for reimbursement of necessary medical expenses incurred by others injured at your workplace as a result of a covered incident, other than a medical incident.

Personal and Advertising Injury
Coverage for claims of privacy violation, slander, libel, and other alleged personal and advertising injuries committed while at your workplace.

Patient First Aid Medical Expenses
This coverage reimburses you up to $10,000 annual aggregate for expenses you incur in rendering first aid to a patient/client.

Services to Animals Property Damage
Payment of up to $10,000 annual aggregate for unintentional damage you cause to someone else’s property, while at your residence or your workplace. Animals are legally considered property in most jurisdictions. Harm to an animal is considered a property damage claim.

Abuse and Molestation
Coverage is provided up to $25,000 annual aggregate, as a sublimit of professional liability, for amounts that you are legally obligated to pay as a result of covered claims involving acts of sexual misconduct related to professional services, provided that there is no determination of liability. There is no coverage for criminal acts, including consensual sexual activity (This coverage is not available in New York).

Media Event Expenses Supplementary Benefits Endorsement
Coverage is provided up to $25,000 annual aggregate for certain fees, such as third party legal or public relations consultants, to address adverse publicity or media attention, including preparation of statements, press releases, and interviews arising from your professional services (Coverage is not available in all states).

Policy terms may vary by state and are subject to state approval.

Claims will be evaluated for coverage based upon the specific facts and circumstances presented, the issued policy terms, conditions and exclusions. If coverage is afforded, the amounts payable under a policy are subject to applicable deductibles and limits of insurance. An interpretation of coverage does not predict the outcome of a claim.
