Man Falls Dismounting Stationary Bicycle - Bicycle Falls on Film, Fracturing Neck - Fusion Required - $1.49 Million Settlement.

The plaintiff, age fifty-nine, underwent physical therapy at the defendant hospital in July 2005. The treatment included his use of a stationary bicycle.

The bicycle tipped and fell while the plaintiff was dismounting, and he fell to the floor.

The bicycle landed on him and he claimed that he sustained a neck injury, which included a C4-C5 fracture, necessitating fusion.

The plaintiff claimed that he continued to suffer residual exacerbation of preexisting conditions which included neck pain, left shoulder pain and spastic quadriparesis.

The plaintiff claimed that the therapist should have supervised the activities he was prescribed for the rehabilitation of a fractured ankle and that assistance should have been given in getting on and off the exercise equipment.

The defendant claimed that the plaintiff was specifically told that he had to remain on the bicycle until a therapist could provide assistance.

According to a published account a $1.49 million settlement was reached.
